Those assets required included your home, although there were various ways the equity within it could be released. You could either remortgage or sell the property. Alternatively you could stay in your home if the Trustee was willing to consider other arrangements, such as a family member or third party paying a lump sum equivalent to your equity. Under those conditions, the Trustee would usually be prepared to forgo their interest in the property. The Mortgage to Rent scheme was also an interesting alternative and allow you to remain in your home.

But problems arose with those homes that had very little equity and were sold. Once all the sales costs were taken into account, the actual amount available to creditors was very little, but because of the rules a Trustee would have still have to sell it. Many people found themselves in this position, and some people refused to leave their homes under such circumstances. And then there were those who had bought their homes with former partners and friends. For obvious reasons, they were annoyed at the possibility of losing their asset for so little value to the creditors. For some, they point blank refused to allow the sale or re-mortgage and the Trustee reached deadlock.

There are few options open to a Trustee when this happens. Take court action to force the sale was and still is one of the most popular, but before they did so they had to obtain either permission of the areas Sheriff if the consent of the owners was not given.

It is rare for a trustee to ask a Sheriff to step in like this and grant them permission to sell the debtors home. Most of the time a compromise can be found long before this. However when it does happen the Sheriff has to spend some time considering the circumstances surrounding the case, so it is by no means a done deal that you will lose your home. The Sheriff takes into consideration the needs and financial resources of everyone involved, except the debtor.

The Sheriff may decide against it if it would cause considerable hardship to the spouse, civil partner, former spouse or former civil partner. In addition, the length of time the occupants have been living in the house and the interests of the creditors are also considered carefully.

But at the end of the day, the Sheriff can do only one of three things. They can a) grant the application so the sale goes ahead, although they can stipulate certain conditions must be met b) grant the application but postpone action for up to 12 months or c) refuse the application.

With the recession and the credit crunch, more and more the decision of the Sheriff tended towards letting the occupants remain with certain stipulations in place. Despite the clear need to debtors to repay what they owe, it was clear too many homes were being forced to sale and its occupants made homeless for what amounted to little for creditors. Worse the local councils would pay to house those occupants while the knock on effects, both physical and mental, to the adults and children concerned began to involve many more organizations who had to step in to help.

In November 2010, the Scottish Government had no choice but to tackle this problem head on. It introduced almost 50 amendments to existing legislation, which included:

* A debtors home to be excluded from a Protected Trust Deed where it is of little value to creditors as long providing it has a mortgage or secured loan against it and the secured creditor agrees in advance not to claim under the Protected Trust Deed.

* A change in definition of property that can be excluded. Formerly this was family home; this has changed to debtors dwellinghouse, which means that single people can now benefit from the changes while simultaneously excluding those people who live in a property that is owned but not occupied by the debtor.

* The Sheriff could postpone action to sell a home for up to three years to allow, for example, a child to complete schooling. This is three times longer than before.

Without even considering the other 47 amendments, these three alone are making the biggest difference to the lives of thousands more people with a Protected Trust Deed. They no longer fear their home being taken and having to go into council emergency housing or rented accommodation over a tiny amount of equity in their property. Finally, they can look forward to a debt-free future, safe and secure in their own home.

It would have triggered cracks within the democratic society which our great grandparents fought hard to build for us. But luckily enough, the Supreme Court applied common sense which saw subsequently resulted in the incarceration of some MPs.

In addition, although Article 9 of the Bill of rights states clearly that members of parliament are unanswerable to the courts for things said in parliament, the British constitution has always impose a responsibility on the shoulders of MPs to respect the judgements and independence of the judiciary. It will be disingenuous and wrong for the British government and its allies to go around the world (as they are doing now) preaching about the importance of democracy, the rule of law, civil liberties and the right for individuals to have free and fair hearing in their respective countries when members of their own country refuse to adhere to judgements made by their domestic courts.

Moreover, one may also trace the root cause of the intrusion of civil liberties from the way the press has been allowed to operate. For so many years the British press has enjoyed an unprecedented right of self-regulation. This self-regulation, although good for freedom of speech, gave the press an unfettered playing field which encourages them to report stories which are damaging to civil liberties even when they know that such stories may have a detrimental effect on the individual and his family. In some cases, some newspapers go the extra mile to hack into the phones of ordinary citizens; a further attempt to infringe upon individuals right to privacy. I am not in any way in favour of a privacy law which may or may not restrict the freedom of speech journalist. However I certainly think it is not morally defendable for a news organisation to plough through the phone records of ordinary people without any compelling reason for doing so.

It is this relentless intrusion of civil liberties by the press that encourages the courts to issue super- injunction to ordinary citizens so as to protect their right to privacy. As judge Eady explained the court’s duty remains to try and protect the claimant, and particularly his family, from intrusion and harassment so long as it can.”

In this regard, it is therefore right for judges to be encouraged by both parliament and the government to continue to devise new ways of protecting civil liberties whiles at the same time making sure freedom of speech is properly upheld. Roddenberrys intention was to use Star Trek as a platform to play out real life issues under the guise of entertainment. Cultural output is thus seen as a mirror of social and political inputsa reflection of sorts of the fears, dreams, and preoccupations of society. (Brynen, 1999) Society as a whole may be unaware of the direction the people are taking in the world. That is until an artist holds a mirror to face of humanity, offering up a chance for self examination and reflection. By presenting this reflection to an audience that is caught up in the story and the interaction of characters, without even being aware of the message, the audience begins to transform ones own thinking about the world around them and their role in the world.

For example, perhaps one of the most carefully orchestrated relationships played out through many incarnations was an alien race known as the Klingons. The introduction of this alien species was an indirect representation of the real life cold war enemy the Russians and the communist fear. The 1960s had been a critical period for the entire world, as a constant nuclear threat was real and always present. Roddenberrys development of the Klingons and the war like society they came from presented the main characters a challenge of tolerance and attempts at finding peaceable solutions to their mutually conflicting backgrounds and cultural mentalities. As in real life, there were the occasional military conflicts, but the continuing message was to continue working through cultural differences for an understanding and peaceful co-existence.

The author cannot say that Star Trek changed politicians thinking, logic, or motivations, but the impact on the social consciousness is evident as society began to evolve through the 1970s and on through to the collapse of the Soviet government. If the reader was to ask a young person about how the cold war affected his or her life, the author would venture to guess that the respondent would have to ask What was the cold war?. In the years leading to the days of the collapse of the Soviet Union, military tensions remained high between the United States and the Soviet Union, but societys view of the threat diminished slightly over time through the decades that followed the 1960s. Was this because of a shared fear of a mutually assured destruction (MAD) and a developing understanding that the people of the Soviet Union were very much like the Americans in shared hopes and dreams? Could the people of Earth survived without one or the other, MAD or an understanding? In Roddenberrys vision, both opponents, the crew of the Enterprise and the Klingons, were equally capable of destroying the other, possibly with significant losses in the process. But Roddenberrys message was always one of finding a means to peace and celebrating shared commonality.

Prior to the 1960s, in the authors opinion, America might as well have been the poster child of white supremacy and ethnic ignorance. Again Roddenberry pushed for diversity in his vision of the future. A time in which people of all ethnic backgrounds would come together as equals in a pursuit of knowledge and exploration.

Roddenberry envisioned a multi-ethnic crew, including an African-American woman, a Scotsman, a Japanese American, and most notably, an alien, the half-Vulcan Mr. Spock. In the second season Roddenberry added a Russian crewmember at a time when the United States was engaged in a tense cold war with the Soviet Union. Blacks and women were also shown as scientists and doctors on the ship. (Day, n.d.)

A unique characteristic about ignorance; it can be coaxed out of existence through exposure to situations that would normally not be observed in common place. Roddenberry presented to families on a weekly basis, adventures and tales of survival so exciting, that people began to see beyond the ethnic representations of the characters and saw a team of people achieving the unbelievable.

Was this tolerance or acceptance by the common people of other ethnicities? Whatever the first step, society has continued to evolve. The abolishment of ignorance has transformed neighborhoods, the workplace, and every other aspect of life towards pure social integration. Just 25 years earlier, prior to the airing of Star Trek, Japanese Americans were sent to camps with no regard to their innocence or place in society. This action was based purely on a racist preconception by government authorities, who were a representation of the American people.

Perhaps more on the minds of outside observers was that the 1960s represented the birth of civil rights, womans rights, and other minority concerns at the time. In no other media outlet at the time was there a representation of ethnic diversity sharing equal and esteemed roles such as scientists, officers, doctors, and engineers. Added to the kettle of diversity was the weekly interaction with alien races. At times, there would be conflict or a shared hardship, but in the end, the message was the same, understanding and appreciation of the differences between the various races, could bring peace to what otherwise could have been a volatile situation.

The integration of ethnic and cultural diversity that the world now enjoys could never have been forced upon a society. Roddenberrys genius was in his ability to present to the world a vision for a future based on changing how humans as a society interact today. Gene Roddenberry once noted that his inspiration came from concentrating on something about our world that annoys meso that I get sufficiently moved, so that I want to write about how, in the Star Trek world, its done differently. (Brynen, 1999) As society continues to grow and celebrates the shared ethnic diversity, perhaps the advances in technology, that sparked the imagination of millions and changed our world, will help to advance the human race to the stars and beyond. But no one is going to the stars until society moves forward as one. At its most basic level, Star Trek had a simple humanistic message: humanity will be okay. (Day, n.d.)

Poverty, homelessness, and unemployment have always been part of the details of any Capitalist system. The many on top are always benefited by colluding, by cutting up markets, and by fixing prices. It is always in their benefit to underproduce food where there is a famine, to underproduce coal where there is a winter. Scarcity increases the value of a product. This is a caused by a system where the few own the majority of land and productive wealth — by the system of Capitalism. But, some have tried to fight it by joining the worker’s party.

The Socialist Party, the Communist Party, the Marxist-Leninist Party, the Revolutionary Workers Party — there are so many titles for this type of political party. By living in a Capitalist system, you see the want, the waste, and the exploitation that exists everywhere. It is natural to change it. Can the worker’s party help you?

A worker’s party would try to make laws to improve the way we live and work. Shorter hours, better pay, more benefits, safety equipment, compensation for injury on the job, among many other areas. But all of these things can also be accomplished by unions. If you want to improve the standard of living for the common masses, organizing them into labor unions is more effective.

For the worker’s party to be able to make any changes, it would have to get into office. Until it reaches the critical point of 51% of the voters, it would not be able to make significant changes to society. It would either be in a coalition with other parties, where its effects would be diluted. Or it would lose the election.

If the worker’s party could achieve 40% of the vote, and it wouldn’t be enough. It would require 51% of the vote to get it into power. But consider 40% of the people going out on strike. This could cripple an entire economy — the steel mills would be shut down, the trucks would stand still, and the harvests would rot.

It would be enough to gain any demand from the Capitalist class or the government. That many workers on strike could end a war, could increase minimum wage, could create employment and jobs. There are people willing to work, willing to consume with their earnings, and then near them, empty lands. The strike could pull that land from the grips of Capitalists, and allow the people to work it.

And that’s the difference between the union and the political party. If we strike to change society, it is because we demonstrated how essential the working class is to the economy. But if we vote for a worker’s party, it will use laws to protect the workers.

These laws will always be received with contempt and bitterness — and they never cut at the direct power of the Capitalist. But a strike makes a Capitalist helpless, and they are put in a situation where they have to negotiate and give in to our demands. The workers’ party makes the capitalist class into an aggressive enemy — the workers’ strike cuts right at the root of capitalism.

From fighting discrimination to environmental protection — from ending wars to improving your standard of living — the union and the General Strike are the greatest tool.

Key issue before NAC: should projects displacing tribals be resisted?

NAC Working Group (WG) headed by tribal expert professor Virginius Xaxa – who also heads the Prime Minister’s high-level committee that is to produce a report on the socio-economic condition of tribals – will examine whether developmental interventions and constitutional safeguards including Fifth Schedule provisions have come to the aid of tribal people in Left Wing Extremism-affected districts in central India. It is expected to zero in on the issues of displacement arising from the various development and mining projects and wildlife sanctuaries, and atrocities and redress of grievances of undertrials. The key question the agenda papers pose is whether -industry, mineral exploitation and other infrastructure development projects that displace tribal communities are to be invariably resisted. Or to be worked out, ensuring overall interest of the tribal communities [livelihood security, environment, culture, improved quality of life, etc].- UPA’s emphasis In recent months, the UPA government – and now the NAC – has once again begun to lay a special emphasis on the condition of tribals: the PM’s high-level committee is expected to come out with a report similar to the one the Sachar Committee produced on Muslims in 2006, ahead of the general election in 2014. The background note for the September 23 meeting admits that tribals -have veered in some areas to left radicalism either as cadres or sympathisers and supporters due to their exploitation and oppression by traders, moneylenders, land-grabbers-and [in the] absence of effective and sensitive civil administration.- The large-scale displacement of tribals in recent years, it says, -has reinforced the discontent- widespread in these areas for decades.- This has happened -despite the special constitutional and legal provisions for the protection of the tribal people in the Fifth Schedule,- as well as a slew of other laws. The note asks the WG to -assess the impact of special programmes for the LWE areas, being implemented over the past 5-6 years- and -review implementation of provisions under the Fifth Schedule and PESA, 1996, the Scheduled Tribe and Other Forest Dwellers (Recognition of Forest Rights) Act 2006, and the Prevention of Atrocities Act.-

The sad story of a good vaccine

The Pentavalent vaccine, the Ministry of Health and Family Welfare’s latest addition to the immunisation programme, has run into a storm. The vaccine is no stranger to controversy. A mix of five vaccines to fight childhood diseases like diphtheria, pertussis, tetanus, Hepatitis B, pneumonia and meningitis caused by Haemophilus influenzae Type B, its roll-out in nine States has been opposed after infant deaths were reported post vaccination. The Supreme Court has sent a notice to the Ministry asking why the vaccine should not be banned in the country. Vaccines are known to be safe and one of the best preventive tools to protect children from disease. In India, nearly three-and-a-half lakh children die of pneumonia and meningitis every year and the best way to save these lives is a vaccine.

Model worth considering

Immunisation is done by health-care providers like auxiliary nurse midwives, who are often not trained enough to recognise clinical symptoms prior to administering the vaccine and the ability to provide support in case of adverse events. Vaccinators need to be well trained in the importance of identifying underlying conditions of the child before vaccinating, make parents understand the risks of vaccinating in case of any underlying condition and ensure post-vaccination care if there is any event of crying, fever and convulsions.

So far, 82.72 lakh doses have been administered in the country and 29 serious cases of Adverse Events Following Immunization (AEFI) have occurred following immunisation. Kerala reported 15 deaths; of these, six children had co-morbidity such as congenital heart disease, eight were Sudden Infant Death Syndrome (SID), where the cause of death is unknown, and one infant probably died due to the vaccine. Haryana reported five deaths, Tamil Nadu four, Karnataka three and Gujarat and Jammu and Kashmir one each. If the public health system provides quality immunisation services and ideal case management AEFI, cases can be minimised.
